Buying property in Dubai as an American: the complete 2026 guide
A US citizen can hold freehold title in Dubai's designated areas under Law No. 7 of 2006, without UAE residency, and pays a Dubai Land Department registration fee of 4 per cent of the price, split 2 per cent each between buyer and seller on the DLD service page accessed on 7 November 2026. At home, the IRS taxes the rent and the gain, requires depreciation over 30 years for residential rental property used outside the United States, and does not treat directly held foreign real estate as reportable on FBAR or Form 8938, although the UAE bank account that receives the rent can be.

This article discusses regulation and costs that can change. Confirm current requirements with the relevant authority before acting.
A US citizen can buy and hold freehold property in Dubai, in the areas the Ruler has designated, without living in the UAE. The Dubai Land Department (DLD) charges a registration fee of 4 per cent of the price, listed on its service page as 2 per cent for the buyer and 2 per cent for the seller when we accessed it on 7 November 2026. At home, the IRS taxes the rent and any gain, and the bank account that receives the rent can trigger FBAR filing, even though the property itself is not reported on FBAR or Form 8938. This guide is general information, not tax or legal advice. Confirm every US position with a US CPA and every UAE position with the authority or a UAE lawyer.
Can an American legally own property in Dubai?
Yes. Dubai Law No. 7 of 2006 Concerning Real Property Registration was issued on 13 March 2006. Article 4 reserves general ownership to UAE and Gulf Cooperation Council nationals and their companies, then provides that non UAE nationals may be granted rights in areas the Ruler determines. Those rights are freehold ownership with no time limit, or usufruct and leasehold for up to 99 years.
The first designation followed quickly. Regulation No. 3 of 2006, issued on 7 June 2006, listed 23 areas where non UAE nationals may hold freehold, including Dubai Marina, Palm Jumeirah, Jebel Ali, Emirates Hills and The World Islands. The list has been amended since, so the practical test for any building is simple: the DLD must be willing to register a title deed or an off plan contract in your name.
Nationality does not change the answer. The DLD sale registration page states that non resident foreigners may present a valid passport instead of an Emirates ID. A US citizen buys on the same terms as any other foreign buyer.
What are the steps to buy a resale property in Dubai?
A resale, or secondary market, purchase usually runs in five steps.
- Agree the price and terms with the seller through a broker licensed by the Real Estate Regulatory Agency.
- Sign the memorandum of understanding on the DLD's Unified Contract F, known as Form F. DXBinteract's guide, accessed on 7 November 2026, describes a security deposit of typically 10 per cent of the price, held by cheque until transfer, and a maximum term of 90 days.
- The seller obtains the developer's electronic no objection certificate through the Dubai REST application, which the DLD lists as a required document for freehold areas.
- If the seller has a mortgage, it is settled, and if you are borrowing, your bank prepares its own registration.
- Buyer and seller, or their attorneys, attend a Real Estate Registration Trustee office. Fees are paid, the transfer is entered, and the DLD issues the title deed in the buyer's name.
How does buying off plan work, and how is my money protected?
Off plan means buying from the developer before completion. The sequence is a reservation, a sale and purchase agreement (SPA), then registration in the interim register through the DLD's Oqood system. The DLD initial sale page, accessed on 7 November 2026, states that the contract must be registered within 90 days of signing and that the purchaser receives a provisional registration certificate by email. Non resident individuals supply a copy of a valid passport.
The money is protected by Dubai Law No. 8 of 2007 Concerning Escrow Accounts for Real Estate Development, issued on 6 May 2007. Article 7 requires payments by off plan purchasers to be deposited in the project's escrow account. Article 9 dedicates that account exclusively to building the project. Pay only into the escrow account named in your SPA, and check that it matches the project record in Dubai REST.
Escrow governs how your money is used. It does not guarantee a completion date or a resale price. Our explainers on how off plan purchases work and off plan payment plans go through each stage.
What does it cost to buy property in Dubai?
The DLD sale registration page, last updated on 3 November 2026 and accessed on 7 November 2026, lists these fees for a completed property:
- A registration fee of 2 per cent of the sale value for the seller and 2 per cent for the buyer, 4 per cent in total.
- A title deed certificate fee of AED 250.
- A map fee of AED 225 under Dubai Municipality, or AED 100 for land outside it.
- Knowledge and innovation fees of AED 10 each.
- A trustee office fee of AED 4,000 plus VAT for sales of AED 500,000 or more, or AED 2,000 plus VAT below that.
For off plan sales, the DLD initial sale page lists the same 2 per cent for each party, the AED 10 knowledge and innovation fees, and an AED 1,000 developer registration fee through Oqood. Who actually bears the 4 per cent is set by the contract, and off plan SPAs often place all of it on the buyer.
The DLD pages do not set broker commission or a lender's fees. Ask for both in writing before you sign.
Can I buy Dubai property without travelling there?
Yes. Khaleej Times set out the route on 10 April 2022. A buyer does not need UAE residency to hold title, and does not need to travel, if a representative in Dubai acts under a power of attorney.
The steps the article describes are these. A Dubai lawyer drafts the power of attorney. You sign it before a notary in the United States. It is then legalised for use in the UAE, attested by the UAE Ministry of Foreign Affairs, translated into Arabic by an approved legal translator where needed, and the translation attested. Your attorney can then sign Form F, attend the trustee office and collect the title deed. Legalisation requirements change, so have your Dubai lawyer confirm the current chain before you sign anything in the United States.
How do I move money from the US to Dubai?
Funds from the United States can be sent by international wire, to the escrow account named in the SPA for an off plan unit, or as the parties and the trustee office arrange for a resale. The currency question is narrow. The Central Bank of the UAE describes its Dirham Monetary Framework as focused on maintaining the dirham's peg to the US dollar, on a page dated 7 April 2025. The National reported on 22 November 2024 that the rate has been fixed at AED 3.6725 to the dollar since November 1997. At that rate, a AED 2 million apartment costs about USD 544,600.
Expect questions about where the money came from. On 8 August 2022, Khaleej Times reported rules from the UAE Ministry of Economy and Ministry of Justice requiring agents, brokers and law firms to report freehold sales paid in cash of AED 55,000 or more, or with virtual assets, and to record the parties' identification. Banks, developers and brokers will ask for proof of funds and source of wealth: bank statements, a sale contract for an asset you sold, or a business or employment record. Assemble that file before you reserve.
What do I report to the IRS when I own Dubai property?
This section states what IRS pages say. It is not tax advice, and a US CPA should confirm how each point applies to you.
Worldwide income. An IRS tax tip issued on 21 March 2023 states that the worldwide income of US citizens and resident aliens is subject to US income tax regardless of where they live.
Rent. IRS Publication 527 (2025) states that the basic form for reporting residential rental income and expenses is Schedule E (Form 1040).
Depreciation. The Instructions for Form 4562 (2025) list tangible property used predominantly outside the United States among the property that must be depreciated under the alternative depreciation system, ADS. The same instructions state that the ADS recovery period for residential rental property placed in service after 2017 is 30 years. A US rental under the general system uses 27.5 years, per Publication 527 (2025).
Sale. IRS Topic no. 409, updated 24 September 2026, treats gains on assets held more than one year as long term, taxed at 0, 15 or 20 per cent depending on income. Unrecaptured section 1250 gain from selling real property is taxed at a maximum of 25 per cent, and the net investment income tax may apply. Sales are reported on Form 8949 and Schedule D.
No treaty. The IRS list of US income tax treaties, updated 3 January 2026, does not include the United Arab Emirates.
FBAR. The IRS FBAR page, updated 30 July 2026, requires US persons to file FinCEN Form 114 when foreign financial accounts together exceed USD 10,000 at any time in the calendar year. It is filed electronically with FinCEN, not with your tax return, and is due on 15 April with an automatic extension to 15 October. A Dubai bank account used for rent or service charges counts towards that total.
Form 8938. The IRS comparison page, updated 19 September 2026, sets the thresholds for individuals living in the United States at more than USD 50,000 on the last day of the year or USD 75,000 at any time, doubled to USD 100,000 and USD 150,000 for joint filers. For individuals living abroad, they are USD 200,000 and USD 300,000, or USD 400,000 and USD 600,000 for joint filers.
The property itself. The same IRS page states that foreign real estate held directly is not reportable on FBAR or on Form 8938. If the property is held through a foreign entity, the entity is a specified foreign financial asset for Form 8938 and its value includes the real estate, while FBAR still does not capture the real estate.
Does the UAE tax my rent or my gain, and can property get me a Golden Visa?
The UAE government portal states that the UAE does not levy income tax on individuals. Corporate tax reaches natural persons only for business activities. Cabinet Decision No. 49 of 2023, dated 8 May 2023 and published by the Ministry of Finance, defines real estate investment as an individual's activity in the sale, leasing and renting of UAE real estate that does not require a licence. Article 2 states that real estate investment income is not a business activity, and the Federal Tax Authority repeats this on its page for natural persons, updated 6 May 2024. Read together, these pages mean that an individual who holds property without needing a licence pays no UAE income tax and no corporate tax on the rent or on the gain at sale. VAT at 5 per cent applies to goods and services, per the same portal.
The Golden Visa is available through property. The DLD investor service page, accessed on 7 November 2026, requires a property value of AED 2 million, wholly owned by the applicant in one or more properties. It allows a mortgaged property with a bank letter showing the amount paid, and describes a 10 year renewable permit. The federal portal u.ae, updated 28 July 2026, lists real estate investors at 5 years with minimum capital of AED 2 million. ICP, the federal authority that issues the permit, settles the point: its Golden Residency guide, updated on 10 September 2026, gives 10 years for investors in the real estate sector. The two pages differ on duration. Our Golden Visa page tracks the current rules.
What it means for investors
For a buyer paying in dollars, Dubai removes two frictions that most foreign markets carry. The dirham has been fixed at AED 3.6725 to the dollar since 1997, so price, rent and sale proceeds carry no exchange rate risk against the dollar. And the UAE does not tax the individual owner's rent or gain, so the return is taxed once, in the United States.
That second point cuts both ways. With no UAE income tax paid, there is no UAE tax to credit against the US liability, so the US return carries the full weight. The 30 year ADS schedule produces a smaller annual depreciation deduction than a US rental receives over 27.5 years. Model your after tax return on US rules, with your CPA, before you compare a Dubai yield with a Miami or Austin yield.
Financing is possible. As our mortgage guide explains, several UAE banks lend to non residents on their own criteria, mainly on completed freehold property, and it sets out deposits, documents and limits, and our guide for US investors collects the questions to raise with your adviser.
Estate planning deserves attention at purchase, not later. The Instructions for Form 706, revised in July 2026, state that the gross estate of a US citizen includes property outside the United States, with a basic exclusion of USD 15,000,000 for deaths in 2026. In the UAE, the DIFC Courts Wills Service registers wills for non Muslims aged 18 or over who own UAE assets, including a Property Will covering up to five UAE properties. Gulf News reported on 5 November 2018 that Abu Dhabi also runs a non Muslim will registration office.
What we recommend
First, decide how you will hold the property before you reserve. Direct personal ownership keeps the IRS reporting simplest. A company or trust may suit estate planning, but a foreign entity brings its own US filings, so take US advice first.
Second, open the paper trail early. Prepare proof of funds and source of wealth, and plan which bank account will receive rent so that you track the FBAR threshold from the first day.
Third, verify, then pay. Check the developer, project and escrow account in Dubai REST, read the fee clause in the SPA or Form F, and use a licensed broker.
Fourth, register a will in the UAE and update your US estate plan in the same quarter.
This guide is not tax advice. Confirm the current position with the authority before relying on it, and confirm every US tax and reporting point with a US CPA.
